These Terms & Conditions ("Terms") govern the supply of goods and services by Otter Air & Electrical ("we", "us", "our") to you, the customer ("you", "your"). By accepting a quote, booking a service, or otherwise engaging us, you agree to be bound by these Terms.
1. About Us
Otter Air & Electrical is a Perth-based business providing air conditioning installation, maintenance, repair, and electrical services across the Perth metropolitan area and surrounding regions of Western Australia.

2. Quotes
Quotes are valid for thirty (30) days from the date of issue unless otherwise stated. Quotes are based on the information supplied by you at the time of inspection or enquiry. Any change in scope, location, accessibility, or unforeseen site conditions may result in a variation to the quoted price.
Quotes are provided in Australian Dollars and include GST unless expressly stated otherwise.
3. Acceptance & Bookings
A booking is confirmed when you formally accept the quote (electronically or in writing) and, where required, pay any deposit specified on the quote. We will then schedule the work at a mutually convenient time.
4. Deposits
Where a deposit is required (typically for installations or jobs involving ordered equipment), the deposit is payable upon acceptance of the quote and confirms your booking. Deposits are applied to the final invoice. If you cancel the booking after we have ordered equipment specifically for your job, the deposit may be retained to cover ordering, restocking, or supplier-side costs we cannot recover.
5. Payment Terms
Final invoices are payable within three (3) days of the completion of work unless otherwise agreed in writing. Accepted payment methods include direct bank transfer, credit card, and EFTPOS. Bank details are provided on each invoice.
Overdue invoices may incur interest at a rate of 2% per month, calculated daily, in addition to any reasonable debt-recovery costs we incur in obtaining payment.
6. Cancellation & Rescheduling
We understand schedules change. We ask that you provide as much notice as practicable if you need to cancel or reschedule. For cancellations made with less than twenty-four (24) hours' notice before a scheduled site visit, a call-out fee may apply to cover the time and travel reserved for your job.
7. Variations
Any change to the scope of work agreed in the original quote ("Variation") may attract an additional charge. Variations may be agreed in writing (including by email or via the customer portal) or verbally on-site between you and our attending technician — verbal agreements are often the most practical when something is found that needs immediate attention. Where a variation is agreed verbally, we will note it on the job record and confirm it on the final invoice. We recommend confirming any significant variation in writing where practicable.
8. Site Access & Customer Obligations
You agree to provide safe and reasonable access to the premises at the time of the scheduled service. This includes:
- Ensuring a responsible adult is present where access requires it
- Clearing the work area of furniture, valuables, and obstructions
- Restraining or removing pets from the work area
- Disclosing any known hazards (asbestos, unstable structures, etc.)
- Providing access to power and water where reasonably required
If we cannot reasonably access the premises or commence work on arrival due to your delay, a call-out fee may apply.
9. Workmanship & Warranty
We warrant our workmanship for a period of five (5) years from the date of completion, unless a different period is expressly stated on the quote or invoice for that job. This warranty covers defects in our installation work but does not cover:
- Manufacturer defects in equipment (covered by the manufacturer's warranty)
- Damage caused by misuse, neglect, or unauthorised modification
- Wear and tear from normal use
- Damage from extreme weather, power surges, or events beyond our control
Manufacturer warranties on supplied equipment (such as split system units, parts, and controllers) are provided by the manufacturer and are subject to their terms. We will assist you in lodging a manufacturer warranty claim where applicable.
10. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be lawfully excluded.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods or services repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
11. Limitation of Liability
To the maximum extent permitted by law, and subject to the Australian Consumer Law guarantees above, our total liability to you in connection with any service or goods supplied is limited to either:
- Resupplying the relevant service; or
- Refunding the amount paid for the relevant service.
We are not liable for indirect, consequential, or special losses, including loss of profits, loss of business, or inconvenience.
12. Electrical Safety & Licensing
All electrical work is performed by licensed electricians in accordance with the Western Australian Electrical Requirements (WAER) and AS/NZS 3000:2018 Wiring Rules. All air conditioning work involving refrigerants is performed by ARC-licensed technicians.
13. Photos & Marketing
We may take photos of completed work for our records and, with your permission, for use in marketing materials. We will never publish photos that identify your property's address or disclose personal information without your express consent.
14. Privacy
Your personal information is handled in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. We collect your contact and property details solely to provide our services, send invoices, and follow up on warranty matters. We do not sell or share your data with third parties for marketing purposes.
15. Force Majeure
We will not be liable for any delay or failure to perform our obligations under these Terms to the extent the delay or failure is caused by events beyond our reasonable control, including but not limited to severe weather, fire, flood, pandemic, government action, or supply-chain disruption.
16. Disputes
If you have a concern with our work or these Terms, please contact us first at info@otterair.com.au so we can attempt to resolve it directly. If we cannot agree, the matter may be referred to the relevant Western Australian consumer protection authority or tribunal.
17. Governing Law
These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. Any dispute is subject to the exclusive jurisdiction of the courts of Western Australia.
18. Changes to These Terms
We may update these Terms from time to time. The version that applies to your engagement with us is the version in force on the date you accept the relevant quote.
